• Any arrangements relating to the use of a vehicle are made solely between the Family and the Educator under the physical Transportation and Vehicle Agreement or online Transport and Vehicle Agreement. The Service is not a party to this agreement and accepts no responsibility or liability for any aspect of transport arrangements.
• The service is not a party to this agreement and accepts no responsibility or liability for any aspect of transport arrangements or accidents within or outside working hours.
• The Service will be provided with license, insurance and registration documentation for record keeping.
• Whilst the Service stores records and copies of documentation related to drivers and vehicles intending to be utilised under the “Transport and Vehicle Agreement”, the Service does not authorise transport, assess, approve or verify the safety, suitability or compliance of any vehicle, car seat, licence, insurance policy, registration or transport arrangement. Responsibility for these matters rests entirely with the Family and the Educator. This includes ensuring:
- The vehicle is registered, roadworthy and appropriately insured for its intended use
- Child restraints are correctly fitted, suitable for the child’s age and size, and used in accordance with Australian law
- All fuel, maintenance and operating costs are agreed between the Family and Educator
- The driver holds a valid and current licence
- All transport decisions are safe, lawful and appropriate for the child
• Whilst the Service stores copies of documentation related to drivers and vehicles, the Service does not assess, approve or verify the safety, suitability or compliance of any vehicle, car seat, licence, insurance policy, registration or transport arrangement. Responsibility of these matters rests entirely with the Family and the Educator.
• In the event that an Educator is required to drive either their own vehicle or the Family’s vehicle during working hours and has taken all reasonable care to avoid a motor vehicle accident, the Family is responsible for any and all insurance excess payments arising from an insurance claim.
• If the Educator is required to drive their own vehicle to transport children during a session of care, the Family is required to reimburse any costs to the Educator for KM’s driven, using the only KM Reimbursement Request
• Families and Educators must resolve between themselves any disputes, repairs, costs, damages, breakdowns, insurance matters, or disagreements relating to transport. The Service will not mediate, manage or be held liable for any transport-related issues, incidents, injuries, claims or expenses.
• The Educator must not drive under the influence of drugs, alcohol, unprescribed medication or emotional distress and the vehicle used during the session of care must be free from cigarettes, e-cigarettes, vape and cigar smoke when children are in the vehicle.
